INDEMINTY

In consideration for being allowed entry into and participation in the activities associated with the Hold ’Em & Hit ’Em Club (the “Club”), I hereby release and discharge the Club and it’s insurance carriers, present and formers officers, agents, representatives, successors, and assigns (‘Released Parties”) from any and all claims, cause of action, suites, or demands for personal injury, death, or property damage, which I or my heirs, assigns, executors, administrators, representatives, or insurance carriers now have or may have in the future, known or unknown, relating to or arising out of my neglect, grossly negligent, and/or intentional acts in connection with my entry into and/ or participation in the Club’s activities.

I further agree, on behalf of myself and my heirs, successors, and assigns, to DEFEND, INDEMNIFY, and HOLD HARMLESS the Club and Released Parties from and against all claims, demands, and causes of action for per sonal injury, death, or property damage, including without limitation all costs, expenses, and legal fees incurred in defending the same, made by or through me, or on my behalf, relating to or in connection with my entry into and/or participation in the Club’s activities.

This indemnity is specifically intended to operate and be applicable even if it is alleged that all or some of the damages being sought were caused as a whole or in part by any act, omission, negligence, sole negligence, negligence per se, gross negligence, breach of contract, intentional conduct, malicious conduct, knowing conduct, violation of statute or common law or any other conduct whatsoever of the parties hereby released.

I further agree to venue in Harris County, Texas for all purposes. I warrant that I have read this Release of Liability and Indemnity Agreement and fully understand it to be a release of all claims, known or unknown, present or future, that I may have against the Club.

I further certify that I am 21 years of age or older and I agree to abide by all Club rules and policies for this ride.

This Release has been read and fully understood by the undersigned.
